Virginia Draft Regulations Limit Retail Stores to 350 Statewide, Triggering Race for Commercial Market Entry

The Virginia Cannabis Control Authority (CCA) has released comprehensive draft regulations governing the Commonwealth’s commercial cannabis market. Outlined in 3VAC10-10 et seq. and updated on September 9, 2026, the regulatory framework sets strict licensing caps, defines entry barriers for prospective entrepreneurs, and establishes operational rules for incumbent medical operators transitioning to adult-use sales.

The rules delineate precise parameters for capital requirements, social equity provisions, facility co-location, and local zoning adherence as Virginia prepares for state-sanctioned commercial operations.

Entry Pathways and License Caps for New Businesses

For prospective entrepreneurs looking to enter Virginia’s commercial market, the rules specify strict structural boundaries and fixed license allocations:

  • Retail Limits: The CCA will cap adult-use retail marijuana store licenses at 350 state-wide.
  • Tiered Cultivation & Microbusinesses: Cultivation is split into five distinct tiers based on canopy size, alongside a dedicated microbusiness license designed for small-scale operators to conduct integrated cultivation, processing, and retail sales under a single license.
  • Application Process: Access to licenses will occur through a published “notice of open applications”. If qualified applicants outnumber available licenses, the CCA is authorized to conduct a randomized lottery. Once preliminarily approved, licensees are given 18 months to establish physical operations, secure zoning, and demonstrate adequate operational capital.
  • Social Equity Waivers: Applicants qualifying as “impact licensees” can apply for fee waivers or reductions for initial application and annual licensing costs. Additionally, impact licensees and microbusinesses are permitted to enter into cooperative agreements—allowing them to lease space, share processing equipment, and co-locate operations to lower capital barriers to entry.
  • Ownership Transfer Restrictions: To prevent predatory acquisitions, impact licensees are prohibited from transferring more than 49% of their controlling interest for five years, unless transferred within an immediate family trust.

Licensing & Renewal Fee Overview

The regulatory framework establishes non-refundable application, initial authorization, and annual renewal fees across all business tiers:

License / Permit CategoryApplication FeeInitial License / AuthorizationAnnual Renewal
Retail Marijuana Store$4,000$20,000$15,000
Microbusiness$1,000$2,500$6,000
Cultivation (Tier I)$3,000$20,000$15,000
Cultivation (Tier V)$7,500$50,000$45,000
Processing Facility$5,000$30,000$25,000
Pharmaceutical Processor (Medical)$10,000$120,000$5,000

Transition Rules for Existing Medical Businesses

Existing medical pharmaceutical processors and their affiliated dispensing facilities face distinct operational and financial structures:

  • Dual-Use Authorizations: Incumbent pharmaceutical processors and cannabis dispensing facilities can obtain authorization to exercise “dual-use privileges,” serving both medical patients and adult-use retail consumers. Under state statute, medical operators converting to adult-use dual-use status are subject to a $10 million statutory conversion fee payable in full or via an approved installment plan.
  • Facility Expansion Limits: Processors remain capped at operating no more than five cannabis dispensing facilities within their assigned Health Service Area (HSA). They may also apply to establish a single additional cultivation location within the same HSA, subject to an $80,000 initial authorization fee.
  • Medical Priority Safeguards: Dual-use facilities must remain open for medical patients for a minimum of 35 hours per week. Pharmacists-in-Charge (PICs) must oversee dispensing areas. While adult-use retail drive-thru windows are explicitly banned across the board, dual-use facilities are uniquely permitted to continue using drive-thru windows exclusively for fulfilling medical patient pre-orders.

Operational and Security Baseline

All commercial operators—regardless of scale—must implement standard operational procedures prior to opening:

  • Location Distance Rules: No retail store, cultivation facility, or dispensing location may operate within 1,000 feet of a school or child day center. Private dwellings are strictly barred from receiving commercial licenses.
  • Inventory Tracking & Security: Facilities must integrate with the state’s electronic radio-frequency identification (RFID) seed-to-sale tracking system. Infrastructure must include auxiliary-powered alarm systems, 24-hour video surveillance retained for 30 days, commercial-grade locks, and strict visitor monitoring logs.
  • Retail Limitations: Automated vending machines, drive-thru retail windows for adult-use sales, and curbside pickup remain prohibited for general commercial retail stores. Individual retail consumer purchases are capped at two ounces of botanical cannabis, eight grams of concentrate, or 800 milligrams of THC in edible products per transaction.
