Virginia will launch a regulated retail marijuana market on July 1, 2027, under House Bill 30. The Cannabis Control Authority (CCA) will now be responsible for writing the regulations and building out a licensing process for businesses that want in on the retail market. Details on licensing — including application timelines and eligibility requirements — will be posted to the CCA’s website as they’re finalized.
The move marks a shift for a state that has allowed medical cannabis and legalized possession for years but has not yet stood up a commercial adult-use retail system.
The same bill also transfers regulatory authority over hemp-derived products from the Virginia Department of Agriculture and Consumer Services (VDACS) to the CCA. That handoff is expected to take place in August 2026, and current Hemp Product Retail Facility Registrations will stay valid through their existing expiration dates. Registered hemp retailers and industrial hemp growers will hear directly from VDACS about how the changes affect them.
The legislation also closes a loophole hemp operators have used for years. It eliminates the so-called “25:1 ratio,” which had allowed hemp products to exceed two milligrams of total THC as long as they contained at least 25 parts CBD for every one part THC. Starting August 15, 2026, any product with more than two milligrams of total THC per package can no longer be produced or sold as a hemp product in Virginia — a change that mirrors the kind of THC-potency caps other states, including Maryland, have imposed on hemp products in recent years.
Separately, Senate Bill 543 expands the CCA’s enforcement powers, authorizing the agency to take action against unlicensed cannabis and hemp businesses and to issue notices of violation, cease-and-desist orders, and civil penalties. Licensed retailers will also be required to display an official CCA-issued decal in-store.
The public can now report suspected illegal cannabis activity to the CCA through a dedicated tip line, 1-844-WEED-TIP, or through a form on the agency’s website.
A handful of additional cannabis-related bills also became law this year, according to the CCA, covering medical cannabis operations, medical cannabis access for terminally ill patients, expungement of police and court records, modification of cannabis-related sentences, and parental rights tied to legally authorized substances.
The rollout comes in stages: hemp regulation shifts to the CCA and the new THC cap takes effect in August 2026, with the retail cannabis market not opening until July 2027. The CCA said it will continue posting updates as implementation moves forward, including through its quarterly newsletter.
