Emergency D.C. legislation offers reliever rules for conditional licensees as buildout deadlines loom

D.C. Mayor Muriel Bowser has signed the Medical Cannabis Licensing and Unlicensed Establishment Enforcement Clarification Emergency Amendment Act of 2026 into law. The emergency measure—enacted July 30 and remaining in effect through October 28, 2026—eases a key real estate threshold for applicants trying to transition out of conditional status.

While city officials position the bill as a necessary adjustment to clear administrative bottlenecks, conditional applicants face strict time limits and continued pressure to convert before agency cancellations begin.

Flexible Real Estate Rules Replace Strict COO Requirement

Under previous regulations, conditional licensees were required to secure a full Certificate of Occupancy (COO) before converting to a standard, location-bound medical cannabis license. The emergency law now allows applicants to advance using either a zoning certificate OR a COO.

This shift provides temporary relief for operators who have secured commercial property but face delays completing construction, inspections, or buildouts. By allowing a zoning certificate to satisfy conversion requirements, the rule change prevents stalled projects from grinding to a halt at the agency level.

The 3-Year Clock and Cancellation Risks

Despite the added real estate flexibility, regulators at the Alcoholic Beverage and Cannabis Administration (ABCA) are maintaining a firm stance on program deadlines.

  • Hard Expiration Limits: Conditional licenses remain strictly valid for three (3) years from their original Alcoholic Beverage and Cannabis (ABC) Board approval date.
  • Enforcement & Cancellations: ABCA has explicitly warned that conditional licenses will be cancelled once their expiration date passes if a complete conversion application has not been formally submitted and accepted.

For many operators navigating the District’s high commercial rents and complex buildout environment, the emergency act offers a temporary procedural bridge rather than a permanent fix—leaving applicants with a narrow window to finalize paperwork before the October deadline.

Conditional operators looking to verify approval dates or submit conversion documentation should contact ABCA directly at ABCA.CannabisLicensing@dc.gov.
