The D.C. Alcoholic Beverage and Cannabis Board (ABCB) is proposing new rules that would finally clarify what medical cannabis retailers can sell alongside cannabis—and what’s off-limits.
Under the rulemaking notice adopted Oct. 22, the Board aims to address a long-standing gray area in city regulations that has left dispensaries unsure whether they can sell non-cannabis goods like clothing, drinks, or food. The absence of clear rules, officials say, has created confusion and potential compliance risks for retailers.
The new proposal spells out clear boundaries: no alcohol, no tobacco, no nicotine, and no non-cannabis vape products. The Board said selling or allowing those products could attract minors and create “nightlife activity” inconsistent with the medical cannabis program’s intent.
At the same time, the rulemaking gives retailers limited flexibility. Shops could sell branded merchandise, cannabis accessories, and prepackaged, non-cannabis infused, non-alcoholic food and drinks to adults over 18. Medical cannabis retailers operating approved safe-use treatment facilities or summer gardens would also be allowed to let patients eat or drink non-infused, non-alcoholic items—if they’re brought in or delivered from outside.
The Board said the changes balance patient experience with public health. “The sale and service of alcohol or tobacco at a business with a Medical Cannabis Retailer License may encourage nightlife activity,” the notice stated, warning of potential impacts on “the peace, order, and quiet” of nearby neighborhoods.
The rulemaking also tightens youth access: minors under 18 would be barred from entering cannabis retail locations unless they’re registered medical patients accompanied by a parent or guardian.
Public comments on the proposal are open for 30 days following publication in the D.C. Register.
