Curio fined another $3k for METRC violations

Curio Cultivation, LLC, a cannabis grower operating in Timonium, Maryland, has entered into a Consent Order with the Maryland Cannabis Administration (MCA) and will pay a monetary fine of $3,000 for multiple violations of the Maryland Cannabis Reform Act and Code of Maryland Regulations (COMAR).

The violations were uncovered during an unannounced inspection conducted on September 11, 2024, at Curio Cultivation’s facility (License No. GA-23-00010). The MCA found that Curio Cultivation failed to maintain accurate and timely data in METRC, the state’s designated seed-to-sale tracking system, specifically regarding plant inventory and proper tagging.

Detailed findings from the inspection include:

  • Flower Room 1A: While 510 mature plants were present as per METRC data, investigators discovered one mature plant without the required METRC tag affixed. This untagged plant has since been confirmed as “green wasted.”
  • Flower Room 2A: The METRC scanner indicated there should have been 1131 mature plants. However, a physical count revealed only 1071 plants, with one found untagged. This untagged plant was also confirmed as “green wasted.” Crucially, 60 mature plants were missing from this room. Curio Cultivation staff informed MCA investigators that these 60 plants had been moved to another flower room approximately five weeks prior, on August 8, 2024, but this relocation was not accurately recorded in METRC.
  • Standard Operating Procedures (SOPs): Curio Cultivation failed to adhere to its own SOPs for inventory management. Specifically, the company did not follow its “Month End Physical Inventory Counts for Cannabis Containing Material” procedures when conducting its August 30, 2024, inventory, and this non-adherence continued for five weeks thereafter.

The MCA cited Curio Cultivation for violating several COMAR provisions, including failing to enter accurate data into METRC, failing to affix or maintain unique METRC RFID tags, failing to record plant relocations in METRC and failing to adhere to its own standard operating procedures.

This follows an additional $8,000 fine for violations of advertising regulations found in 2024

Following a Letter of Non-Compliance issued by the MCA on Nov. 19, 2024, Curio Cultivation submitted a Plan of Correction on Dec. 2, 2024, which the MCA deemed satisfactory later that month.

As part of the Consent Order, Curio Cultivation is mandated to schedule another plant inventory within 10 days of the Order’s execution. If any untagged plants are discovered during this inventory, video footage must be provided to the MCA confirming their “green wasting.” The $3,000 monetary fine will be paid directly to the Maryland Cannabis Administration’s Compassionate Use Fund within 10 days of the Order’s date. Curio Cultivation is also responsible for all costs associated with complying with this Order.

David Bronfein, General Counsel for Curio Cultivation, LLC, signed the Consent Order on July 17, 2025, acknowledging the violations and agreeing to the terms.
